WAIVER, RELEASE AND HOLD HARMLESS AGREEMENT

In consideration of being permitted by Jazz In The Country, Inc. (“JIC”) to participate in Jazz In The Country events, including any related training sessions and/or festival setup or breakdown activities (collectively, the “Activities”), whether occurring before, during, or after any event produced by JIC, I represent, covenant, and agree on behalf of myself and my heirs, assigns, personal representatives, and any other person claiming by, under, or through me, as follows:

1. Assumption of Risk

I acknowledge that participation in the Activities involves inherent and potential risks, including but not limited to physical injury, illness, exposure to communicable diseases, property damage, disability, or death. I understand that such risks may arise from a variety of circumstances, including but not limited to weather conditions, crowd movement, equipment, staging, electrical components, food service areas, travel, volunteer tasks, or the acts or omissions of others.

I voluntarily assume and accept all risks of injury, loss, damage, or harm arising out of or relating to my participation in the Activities, including any associated travel, whether or not caused in whole or in part by the negligence or other fault of Jazz In The Country, Inc., and/or its officers, directors, agents, employees, volunteers, performers, production staff, vendors, contractors, sponsors, venue hosts, or insurers (collectively, the “Released Parties”).

2. Waiver and Release

I hereby waive, release, and forever discharge the Released Parties from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses of any kind, whether known or unknown, foreseen or unforeseen, that arise out of or relate to my participation in the Activities, including any claims alleged to be caused in whole or in part by the negligence or other fault of any of the Released Parties.

3. Indemnification and Hold Harmless

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys’ fees and litigation expenses) arising out of or relating to my participation in the Activities, including claims brought by me or by anyone claiming by, under, or through me, whether or not caused in whole or in part by the negligence or other fault of any of the Released Parties.

4. Emergency Medical Authorization

In the event of illness or injury during the Activities, I authorize Jazz In The Country, Inc. and its representatives to obtain emergency medical treatment for me if deemed necessary. I understand that I am responsible for any and all medical costs incurred as a result of such treatment. I further acknowledge that JIC does not provide medical or health insurance coverage for volunteers or participants.

5. Volunteer Assignments

Volunteer assignments and placements are made on a first-come, first-served basis. JIC reserves the right to reassign volunteers as necessary to ensure safe and efficient event operations. Any reassignment will be communicated prior to or during the event as appropriate.

6. Media Release

By registering to volunteer or participate, I grant Jazz In The Country, Inc. permission to use my name, image, likeness, and voice in photographs, video recordings, livestreams, promotional materials, social media, digital or print publications, and other media for promotional, marketing, educational, and fundraising purposes without compensation.

7. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to conflict of law principles. Any legal action arising out of or relating to this Agreement or the Activities shall be brought exclusively in a court of competent jurisdiction located in Maryland.

8. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Acknowledgment and Voluntary Execution

I represent and warrant that:

(a) I am at least eighteen (18) years of age;
(b) I have carefully read this Waiver, Release and Hold Harmless Agreement in its entirety;
(c) I fully understand its contents and legal significance;
(d) I understand that I am giving up substantial legal rights; and
(e) I sign it voluntarily and of my own free will.
